How do I sell land I own with family members or co-owners?
The short answer
To sell the whole property, every owner on the deed usually has to agree and sign. Start by confirming exactly who the owners are, agree on a price and how the money will be split, and then sell through a title company or real estate attorney who pays each owner their share at closing. If an owner won't agree, a buyout or mediation is usually the next step, and an attorney can explain the legal options.
1. Confirm who the owners are
Check the most recent deed (from the county Register of Deeds) to see whose names are on it. With inherited land, the owners may be heirs whose names aren't on the deed yet. See inherited land in Tennessee or inherited land in North Carolina.
2. Agree on the important things early
- Whether to sell at all, and whether anyone wants to buy the others out
- A price range everyone can accept. A written cash offer can help everyone see a real number
- How the money will be split. This usually follows each person's ownership share
- Who will be the contact person with the buyer
3. Sign and close
The title company or closing attorney sends documents to each owner. Owners who live in different places can often sign remotely. At closing, any taxes or liens are paid, and each owner can receive their share directly.
What if one owner won't agree?
- Talk it through. Often the holdout has a specific worry, like price, timing or family history.
- Offer a buyout. Those who want to sell can sell their shares to the one who wants to keep the land, or the reverse.
- Try mediation. A neutral mediator can help families reach an agreement.
- Get legal advice. Co-owners generally have legal options, such as asking a court to divide or sell the property, but it takes time and money. An attorney can explain what applies to you.
